Amy Lynn Black was sentenced in October for second degree murder and two chiefs of possession of a controlled substance with intention to sell, all crimes. The jurors acquitted her with a plot to commit murder.
She was sentenced as part of the murder of Carlos Beltran Aguilar, 35, in the afternoon of August 26, 2019, in Villa Motel, 11672 Beach Blvd.
Co-defender Joel Brandon Martinez was sentenced last year of second degree and conspiracy to commit a crime as well as possession of a firearm by a criminal, all crimes, with an improvement in the sentence for the release of a firearm. Martinez awaits the conviction.
The co-accused Gilbert Timothy Ramirez and Brandon Garet Iseminger both accepted advocacy agreements, Ramirez sentenced in 2023 to 10 years and four months in prison while Aisminger awaits the conviction.
One of the daughters of Aguilar, Adriana, told the judge of the Orange County Superior Court, Gary Paer, how she remembered having learned that her father had died.
“My father’s death affected me a lot,” said Adriana. “One, for me, I think I finally found a person who took me like their own and treated me like his and whom I liked as his and who has never thought there twice. Also, for me to shoot the Big 15 and I can’t even spend my big special day with him, and for him to see me become the attentive young woman he told me to be. ”
Another girl, Jennifer, recalled how her heart sank “with disbelief” when he learned her death, especially since “two days before his death, my older sister told us that he was trying to change his life and get his own place, so that we can finally stay night with him.”
She said that Aguilar was “always my biggest supper with my mother, but my father always said to me:” Mija, you are strong, continue to push “. These words always play in my head when I need it most.
She said that her father “made jokes” and was “just a person you can be yourself”. She described it as “sweet and sensitive but strong spirit”.
Aguilar liked to take the girls to a “favorite restaurant” or the park to “play for hours,” said Jennifer.
Another girl, Layloni, said that she was still having trouble believing that her father left.
“Until this day, it is still difficult to believe,” she said. “It always hurts me inside that he is no longer there with us.”
She said that she had trouble with depression and that she was a “daddy’s girl”. She said she always feels “so lost without him. I missed a lot of school because of this.”
Layloni recalled how two nights before his death, he called her and said he had obtained an aligned job and worked on “get an apartment for me and my sisters to start spending the night with him. I was so excited because my father started to change his life. Then, two days later – he was no longer with us.”
The defendant sold drugs from his Motel room, the senior assistant prosecutor Alexa Elliott told her declaration of opening of the trial. “His room was a rotating door.”
Martinez, who was known as “Capone”, was one of its main suppliers, said Elliott.
The prosecutor said that Black and Aguilar “had a very volatile relationship”.
Aguilar sometimes remained with black, but also lived with a cousin, said Elliott. Black was angry when she found that he was sometimes sleeping in his car without authorization, said the prosecutor.
“They fought a lot,” said Elliott. “Carlos was a heroine user and Amy preferred methamphetamine.”
In the days before the murder, the two fought for drug use and “cheating,” said Elliott.
The black also argued Martinez on the quality of the methamphetamine he provided, said Elliott.
The prosecutor showed the jurors several exchanges of SMS she had with friends leading to murder, complaining of Aguilar.
In one of the text messages, she said that Aguilar “had chosen whores and dope” on her, said Elliott.
Black also asked his friends to help him find his boyfriend, said Elliott. These messages, she added, “goes a lot to her intention and her motif.”
She said Black was embarrassed and felt lacking in respect.
The accused sent a “text storm” to the victim around 2 am on the day of the murder, said Elliott. When the two met around 9 a.m. at the motel, they entered a conflict that led him to break the door. While driving his bike, she chased him from wanting him to want him, told investigators, according to Elliott.
Black tried to call Martinez, but he was released late in a drug game house and was sleeping, so he didn’t immediately answer, said Elliott.
“I do not pay to be ignored,” she said in a text to Martinez, according to the prosecutor.
“She said to Capone:” I need your help, “said Elliott.
When Martinez woke up with the messages, he asked the friend with whom he stayed if he could take his car and go to the motel, which was about 10 minutes, Elliott said.
Meanwhile, Aguilar was deposited by his cousin at the motel to pick up certain things while they were on their way to take the victim in a drug rehabilitation establishment, said Elliott.
Martinez presented himself shortly after with Ramirez and Iseminger, and he kicked the door when there was no response, said Elliott.
Martinez stood on the bed in the bedroom when he killed Aguilar, the killing, said Elliott. Martinez had ordered her to get out of the room, but when Aguilar went to kiss Black, Martinez shot him, said the prosecutor.
“It’s an execution at a time,” said Elliott.
While Aguilar moaned in the doorway, “Amy calls his dog” who fled after the shot, said Elliott.
Black also caught several articles in his room, put them in bags and put them back to others before the police arrived, said Elliott. One of the bags, which was recovered in a trash can, contained drug accessories, said Elliott.
Iseringer and Ramirez were not aware of the plan to shoot Aguilar, so they received advocacy agreements, said Elliott.
