Trump’s comments on Musk and Doge are already part of a legal fight

During his spouse in the congress, President Donald Trump continued to call Elon Musk the head of the White House office.

“I created the brand new ministry of government efficiency, Doge, maybe you heard about it, which is led by Elon Musk, who is in the gallery tonight,” Trump said in his speech on Tuesday evening.

Trump’s habit to say that Musk is in charge of the group has already created legal headaches for its administration, which has repeatedly declared that the CEO of Tesla does not really direct Doge.

A group of complainants contesting the constitutionality of DOGE immediately alerted a Washington, DC Federal Judge to Trump’s comments almost as soon as the president ended his speech.

“At around 9:46 p.m., President Trump said the following in his spouse in the congress,” the complainants wrote in their file.

The complainants, who include two lawyers, quickly filed a complaint against the Trump administration the day Trump was sworn in, arguing that Doge’s creation violates the transparency requirements of the 1972 Federal Advisory Committee. The trial declares a federal advisory committee which should be submitted to the FACA law.

The law, which has been designed to stimulate public responsibility, covers the advisory committees that are either trained or used by the President.

A modified trial deposited by the complainants indicates that “Musk continues to speak for DOGE and to attribute the merit of DOGE’s activities, without being” the administrator of the United States.

DOGE was zero by a change of brand of the United States digital service – a technological unit hosted at the president’s executive office.

“DOGE continues to take measures which are not entirely linked to the mandate of the USDS stated” in the first decree of Trump, an official decree which formally established Doge, according to the modified complaint.

US district judge JIA COBB has since consolidated the case with two other similar cases.

Trump’s joint comments were mentioned in another court in a Maryland case brought against Musk and Doge by 26 current and former USAID workers.

The lawyers of the complainants deposited a letter to the federal judge supervising the case asking the court on Wednesday “to take a judicial opinion from these relevant admission”.

“The complainants respectfully write to attract the attention of the additional court to relevant admission made last night. Defenders agree to provide these facts to the Court,” said the letter. “During his spouse in the congress, President Donald Trump twice identified the Musk defendant as the Doge leader.”

The applicants’ trial alleges that Musk’s actions in the Trump administration are “unconstitutional”.

And a new trial lodged Washington, DC, a federal court against Musk and the Trump administration also cites the joint speech of Trump on Wednesday.

“Mr. Musk acts as a main service officer in the United States. However, Mr. Musk was not appointed to an officer’s position in the United States, in accordance with the appointment clause,” said the trial, which was brought by a group of non-profit organizations, including Japanea American Citizens League.

Meanwhile, a senior White House official previously declared before the Federal Court that Musk was neither the administrator of the Doge Office or even an employee of the group. The White House has also pointed out several times that Musk is only a main advisor to the president. After weeks to refuse to publicly appoint the administrator of DOGE, the White House said that Amy Gleason, an employee of the American digital service, was the acting administrator of the Doge Office.

Several signs suggest that Musk remains the de facto leader of Doge, dating back to the initial creation of Trump of “the Ministry of Effectiveness of the Government”, when he appointed the billionaire as a co-leader.

Barely a few days ago, a lawyer for the Ministry of Justice had trouble answering the questions of a district court on the Doge structure. Anna Bower, editor -in -chief of the legislation, published part of the exchange on X.

“Who was DOGE leader before Amy Gleason?” Judge Theodore Chuang asked the MJ lawyer, Joshua Gardner.

“I can’t answer this. I don’t know,” replied Gardner.

Trump is no stranger to making public statements that create headaches for the Ministry of Justice.

During his first mandate, Trump tweets were used several times as proof in various prosecution against his administration.

At one point, the DoJ said Trump tweets were not presidential actions.

The White House did not immediately return a request for comments to Business Insider.
