Former President Donald Trump is running out of legal options to delay the Monday start of his secret trial in Manhattan, legal experts predict.
Trump’s lawyers were eliminated 0-3 this week, when three Manhattan appeals judges rejected three separate emergency delay bids during arguments Monday, Tuesday and Wednesday.
Barring an unforeseen, non-legal emergency, jury selection in the first of Trump’s four criminal cases will begin as scheduled Monday morning in Lower Manhattan Supreme Court, experts said.
“I think they’re running out of steam here,” when it comes to offers of pretrial delays, Barry Kamins, a retired New York Supreme Court justice, said with a laugh Thursday.
“I think the only thing that could stop the trial now would be a health issue, meaning whether Mr. Trump was suffering from an illness or whether there was a health reason,” he said. -he declared to Business Insider.
“But it would be looked at very carefully,” said Kamins, former head of policy and planning for the state court system, and now a partner at Aidala Bertuna & Kamins.
“I do not see any other legal options to delay the trial other than health reasons” on the part of the accused, he added. “And that would only delay the trial by a few days or weeks at most.”

Mid-trial legal delays also unlikely
Trump still has three appeals pending, challenging state Supreme Court Justice Juan Merchan’s silencing order, his ability to impartially preside over the secret trial and his recent efforts to curb Trump’s pretrial motions. 11:00.
The defense and Manhattan prosecutors will file paper arguments on all three efforts over the next two weeks. The cases are moving forward on an accelerated schedule, so three full panels of appellate judges could issue three rulings by the end of the month, perhaps even through opening statements.
But even if Trump wins — and that’s far from the case — it’s highly unlikely that any of these three appellate rulings would stop or even suspend the trial, the experts also said.
And if he loses all three decisions, the state’s highest court, the New York Court of Appeals, is highly unlikely to halt a pending trial, even if its judges agree to hear the cases.
“They don’t have to take it at all, and I would be surprised if they took it in the middle of a trial,” said Paul Shechtman, a former federal prosecutor in Manhattan, where he was chief of appeals.
Ditto at the U.S. Supreme Court, where Trump may ultimately end up, given that all three appeals raise constitutional questions, Schechtman said.
These challenges would all arise after the trial, not during it, agreed Kamins and attorney Michel Paradis, who teaches national security and constitutional law at Columbia Law School.
“It’s very, very unusual to suspend a criminal trial” when it’s already underway, Paradis said.
But even though Trump’s lawyers failed to stop the lawsuit, their efforts may not be in vain in the long run.
Trump’s lawyers have complained, so far unsuccessfully, that he has been denied his right to campaign, under the First Amendment, and his right to a fair trial, under the Sixth Amendment.
By raising constitutional questions now, as part of these failed delay attempts, Trump’s lawyers are setting the stage to challenge his conviction in the highest courts in the state and nation, Paradis said.
“Somehow, by removing the word ‘Constitution’ from all of their pleadings, Trump’s legal team achieves the goal they need to bring the case to either the New York Court of Appeals York, or before the Supreme Court of the United States,” he said.
