Trump files motion to stay sentence in New York case

President-elect Donald Trump has filed a motion to stay the Jan. 10 sentencing in New York v. Trump, Fox Digital has learned.

“Today, President Trump’s legal team took steps to stop illegal convictions in the Manhattan DA’s witch hunt. The Supreme Court’s landmark ruling on immunity, the constitution of New York State and other established legal precedents demand that this baseless hoax be immediately dismissed.” Trump spokesperson and new White House communications director Steven Cheung told Fox Digital Monday morning.

“The American people elected President Trump with an overwhelming mandate that demands an immediate end to the political militarization of our justice system and all remaining witch hunts. We look forward to uniting our country in the new administration as the President Trump will make America great again,” Cheung continued.

New York Judge Juan Merchan set Trump’s sentencing date in the case for earlier this month, before his inauguration as president on January 20. Trump is scheduled to be sentenced on Friday, January 10 at 9:30 a.m.

​​Trump was found guilty of 34 counts of falsification business records in the Manhattan case in May. Manhattan District Attorney Alvin Bragg’s office worked to prove that Trump falsified business records to conceal a $130,000 payment to former porn star Stormy Daniels before the 2016 election in order to make hushing up her allegations of an alleged affair with Trump in 2006.

Trump has maintained his innocence in the case and repeatedly criticized it as an example of legislation promoted by Democrats in an effort to harm his election efforts ahead of November.
