Tony Buzbee: Efforts to settle claims against Brandon McManus were made before filing suit

Tony Buzbee is back.

The lawyer who represented more than 20 women who filed charges against Browns quarterback Deshaun Watson for sexual misconduct during massage sessions represents the two flight attendants who claim the former Jaguars (now Commanders) kicker Brandon McManus sexually assaulted them on a flight from Jacksonville to London.

Buzbee posted this message on Instagram regarding the litigation: “For those who have inquired, the Buzbee Law Firm is the lead attorney for the two women who brought this case. We filed the case on Friday, but prior to that filing we attempted, unsuccessfully, to resolve this issue without the need for a trial. Our resolution efforts have been met with arrogance, ignorance, and stupidity, which is strikingly similar to the reaction of Deshaun Watson’s team when we attempted to resolve these cases before filing. The allegations made in this lawsuit are very serious. We made sure to review them thoroughly and speak to witnesses before even taking on the cases. We will pursue this matter with the same tenacity for which we are renowned. It’s a shame that this type of behavior still happens. This happens too often. These women were just trying to do their jobs!

It is unclear when McManus and/or the Jaguars were first made aware of the claims, or whether the NFL was made aware of the potential violation(s) of the Personal Conduct Policy. It’s also unclear whether the information was leaked to commanders before McManus signed with them earlier this year.

Although the case has been described as an “extortion attempt”, it is normal and customary for lawyers to send a formal notice before taking legal action. As mentioned in the attached clip, my first writing assignment in law school was to write a demand letter.

They are sent daily, from coast to coast. But hundreds, even thousands.

The question in response to each demand letter is whether pre-trial settlement efforts are taken seriously or whether they are rejected. Watson, by refusing to respond to a fairly weak opening request from his first alleged victim for $100,000, learned the hard way. It remains to be seen whether McManus and the Jaguars will learn a similar lesson.
