The Supreme Court Thursday unanimously In favor of a hetero woman who lost posts against gay workers twice, saying that a court of appeal was wrong to force her to respond to an increased burden by seeking to prove discrimination in the workplace because she was a member of a majority group.
The decision occurred two years after the Supreme Court Admission programs concerned with the race In higher education and in the midst of the Trump administration’s fierce efforts to eliminate programs that promote diversity and could facilitate whites, men and other members of the majority to pursue complaints of employment discrimination.
The standards to prove discrimination in the workplace under a federal civil rights law, wrote judge Ketanji Brown Jackson for the court: “does not vary according to whether the applicant is a member of a majority group.”
The case was carried by Marlean A. Ames, who had worked for the Ministry of Ohio Youth Services, which oversees certain parts of the State’s juvenile correctional system. After a decade there, in 2014, she became the administrator of a program addressing a rape of prison. Five years later, she asked for a promotion.
Her supervisors refused her, saying she was lacking in leadership vision and skills. They finally gave the post to a gay woman who had been in the department for a shorter period and, unlike Ms. Ames, had no university diploma.
Shortly after having denied him the new position, his supervisors withdrew him from his existing work, telling him that they had concerns about his leadership and offering him a demotion which came with a reduction in substantial salary. It was replaced by a gay by less seniority.
