On Wednesday, the Supreme Court ruled for the food and drug administration in its repression against vaping products with sweet flavor after an increase in the use of electronic cigarettes for adolescents.
But the unanimous decision of the judges throwing a decision of the Federal Court of Appeal is not the last word of the case, and the FDA could change its approach now that President Donald Trump has promised to “save” vaping.
The High Court ruled that the FDA, during the administration of President Joe Biden, did not violate the federal law when it refused a request from the company of Dallas Triton Distribution to sell E-Justs like “Jimmy the Juice Man in Peachy Strawberry” and “Suicide Bunny Mother’s Milk’s and Cookies”. The products are heated by an electronic cigarette to create an unharmed aerosol.

The FDA has rejected applications for more than a million nicotine products formulated to have a taste for fruit, desserts or candies because their manufacturers could not show that flavored vapes had a net public advantage, as required by law.
He approved some tobacco flavor vapes, and recently, he enabled his first electronic cigarette to flavor of menthol for adult smokers after the company provided data showing that the product was more useful for quitting smoking.
But the 5th Cour of Appeals Conservative rose to the side of Triton, agreeing that the FDA has changed its standards with little warning in federal law.

While ruling mainly for the FDA on Wednesday, the Supreme Court noted that the agency said that the company’s marketing plan would be an important factor in the assessment of its request. But he ultimately did not take into account the marketing plan, wrote Samuel Alito for the court.
The Court of Appeal was ordered to examine whether it is not an important error that could still lead to a decision in favor of Triton.
