The second federal judge ordered a temporary break to Trump administration efforts to freeze funding

Boston (AP) – A second federal judge ordered a temporary break in Trump administration on Friday efforts to freeze federal funding In the last torsion on the expenditure of billions of dollars in subsidies and loans.

Judge John McConnell ranked on the side of nearly two dozens of state that asked an emergency prescription preventing most of the federal agencies from stopping funding.

Another judge in Washington interrupted the plan Earlier this week, a few minutes before it was to come into force, but its short -term order is only in place until Monday unless it decides to extend it.

McConnell ordered the federal government not to “pause, freeze, hinder, block, cancel or terminate” the funding promised to the States while the temporary prohibition order is in place.

“The court must act in these first stages of the dispute in the” worst scenario “because the extent and ambiguity of the action of the executive make it impossible to make it different,” wrote McConnell.

The decision was welcomed by several of the states which were part of the trial.

“Today’s court’s decision reaffirms that the president cannot unilaterally withdraw federal funding, in particular the resources on which our children, the elderly and the economy count. His reckless actions triggered chaos and confusion, however, were the subject of enormous power of the Attorney General to retaliate, “said Massachusetts prosecutor Andrea Campbell in a statement. “My office will continue to fight to protect residents of Massachusetts from these flagrant and illegal abuses of power.”

The prosecutor general of Rhode Island, Neronha, said that he appreciated the fact that McConnell saw the “irreparable damage that this directive would cause and have already caused Americans across the country”.

“Make no mistake: this federal financing break was implemented to inspire fear and chaos, and it has succeeded in this regard,” Neronha said in a statement. “These tactics are intended to exhaust us, but with each legal victory, we reaffirm that these important and illegal disturbances will not be tolerated and will certainly be welcomed with rapid and immediate action now and in the future.”

The federal government had opposed the order, arguing that there was no basis for what they described as “radical help”.

The decision of McConnell, which is based in the Rhode Island and was appointed by former President Barack Obama, occurs despite the management office and the budget for the cancellation of a memo describing a break of federal loans and subsidies .

McConnell found that the recession was “in name only” and that his order was still necessary.

The White House press secretary said that a freezing freezing was still planned in accordance with the Blitz of President Donald Trump’s decrees.

The Republican President wants to increase the production of fossil fuels, eliminate protections for transgender people and the efforts of diversity, equity and final inclusion.

Administration officials insisted that in spite of confusion, their actions still had the planned effect by emphasizing the federal agencies their obligations to respect Trump’s decrees. This prompted States to request the temporary ban order.

In their request, the lawyers of the Ministry of Justice of Trump argued that the Federal Court lacked jurisdiction and that the complainants could not use an order which was initially against the note of the MAMB to seek wider measures against Trump decrees.

They also argued that Trump and the CMB “clearly have the power of Imence to agencies to fully implement the president’s agenda, in accordance with the underlying statutory authorities of each individual agency”.

“The authority of the president of directing the agencies subordinate to implement his program, subject to the own statutory authorities of these agencies, is well established,” wrote Brett Shumate, an interim deputy prosecutor.

The Trump administration has not made immediate comments on the order.

The decision in favor of the States was not unexpected.

During a hearing on Wednesday on the initial order of states on Wednesday, McConnell had declared that he was sympathetic to the advanced argument of states on the potential damage of any frost of federal funding.
