The judge refuses to block the transfer of detainees in the driving of the death granted by the leniency by Biden in the installation “Supermax”

A federal judge refused to intervene on behalf of 21 former federal detainees of Federal Death that the Trump administration seeks to transfer to the country’s most restrictive prison installation, judging Tuesday that men had not exhausted other legal avenues to combat their transfers.

In a notice Consulted overnight, Judge Timothy J. Kelly of the Federal District Court of the Columbia district wrote that men, whose sentences were commissioned in prison without the possibility of parole by former president Joseph R. Biden Jr. in December, had not directly challenged the transfer with the prisons.

“The Bureau of Prisons offers an administrative process to challenge the final designations to ADX, and the complainants have not finished – or, to the attention of the Court, have even started – this process,” he wrote, using the stenography for the United States Maximum Administrative Penitentiary In Florence, Colorado, sometimes called the Alcatraz of the Rockies.

The lawyers of men had argued that the efforts of the government to transfer them to the federal prison of “Supermax” alone, known for its punishing conditions, were motivated by Animus.

After Mr. Biden Commissioned sentences Of 37 men, all found guilty of murder and faced with the death penalty, President Trump was unleashed, telling them in an article on social networks the day before Christmas to “go to hell!”

In the hours after taking office on January 20, Trump signed a executive decree Ordering his Attorney General to ask the death penalty more regularly – the appellant an “essential tool” – and to ensure specifically that the 37 men were “imprisoned in conditions compatible with the monstrosity of their crimes”.

During a hearing in May, Carmen Iguina-Gonzalez, a lawyer appearing on behalf of the 21 men who continued to stop the transfer, describes in detail the psychological effects that lonely isolation and other severe prison conditions may have.

She argued that men would be confronted with these extreme conditions in the installation of Colorado’s “Supermax” – which she said that the prison officials themselves call a “clean version of hell” – only because Mr. Trump sought to take the prevail over the use by Mr. Biden of his powers of Clémence.

During a hearing last week, judge Kelly expressed doubt that transfers were poorly made.

While the legal team representing men raised concerns that some had medical conditions which had not been taken into account in the context of transfer plans, judge Kelly said that he had attended other administrative gaps in the penitentiary system and believed that at least some of these apparent oversights could have been accidental.

In his decision, however, he wrote that men should have the opportunity to exhaust other calls before being transferred and that the court could ultimately reach a different conclusion.

“However, the Court is expecting the prisons office – if, as it affirms, it applies its normal process here – will follow what it maintains is the usual practice of not transferring the complainants before their administrative calls conclude,” he wrote.
