The judge governs the United States must return the man expelled in Salvador in “Error”

A federal judge ordered the Trump administration to return a man from Maryland who was wrongly expelled to a prison in El Salvador.

Kilmar Abergo Garcia, who was expelled last month with hundreds of members of alleged gangs, must be returned to the United States at the latest on Monday, the American district judge Paula Xinis ordered.

Us Immigration and Customs Enforcement (ICE) declared in a recent depositor that Mr. Garcia’s deportation was an “administrative error”. An immigration judge granted him legal protection against expulsion in 2019.

The White House alleged that Mr. Garcia is a member of the Gang MS-13, but his lawyers argued that there was no evidence to prove that he is affiliated with the gangs.

Mr. Garcia’s lawyers also argued that he had never been accused of a crime in a country.

Setting his order on Monday, judge Xinis described Mr. Garcia’s expulsion “an illegal act”.

“The congress said that you could not do it and that you did it anyway,” she told lawyers for the Ministry of Justice.

US lawyers have argued that the government is helpless to reverse expulsion because Mr. Garcia is now in police custody.

Mr. Garcia’s lawyers said the Trump administration’s statements were “scandalous”.

“They come to this court and say:” We have tried nothing and we are not all options “, lawyer Simon Sandoval-Moshenberg told Judge Xinis.

Mr. Garcia’s family, including his wife Jennifer Vasquez Sura – an American citizen – calls for his release since his deportation in mid -March. Ms. Sura told journalists that she had not spoken to her husband since he had been taken by the American authorities.

The case has scandalized many of those who have raised concerns about the recent deportations carried out by the Trump administration of non-citizens who are legally in the United States.
