The great federal jury charges the Wisconsin judge in the event of immigration, allowing charges to continue

Madison, Wisconsin (AP) – A great federal jury charged on Tuesday a Wisconsin judge accused of having helped a man to escape the immigration authorities, allowing the case against her to continue.

The arrest of the County Count of Milwaukee Circuit, Hannah Dugan, intensified a confrontation between the administration of President Donald Trump and the local authorities on the repression of the immigration of the Republican. Democrats accused the Trump administration of having tried to make a national example of Dugan to cool the legal opposition to repression.

Prosecutors charged Dugan in April by complaint to hide an individual to prevent arrest and obstruction. In the federal criminal justice system, prosecutors can directly launch accusations against a defendant by fileing a complaint or by presenting evidence to a large jury and let this body decide if it should issue accusations.

A large jury still examines the accusations made by complaint to determine if there is a sufficient probable cause to continue the case as a check for the power of prosecutors. If the Grand Jury determines that there is a probable cause, it issues a written declaration of the accusations known as the accusation. This is what happened in the case of Dugan.

His case is similar to that provided during the first Trump administration against a Massachusetts judge, who was accused of having helped a man to sneak a back door of the courthouse to escape a pending immigration agent. This case was finally rejected.

According to the prosecutors, Dugan escorted Eduardo Flores-Ruiz and his lawyer for his courtroom through a door of the back jury on April 18 after learning that American immigration and customs application were at the courthouse to ask for his arrest.

According to court documents, Flores-Ruiz returned to the United States illegally after being expelled in 2013. Online judicial files show that he was accused of three heads of domestic violence in the county of Milwaukee in March. He was in Dugan’s courtroom this morning of April 18 for an audience.

The court documents suggest that Dugan was alerted to the presence of the agents by his clerk, who was informed by a lawyer that the agents seemed to be in the corridor. An affidavit says that Dugan was visibly angry with the arrival of the agents and called the “absurd” situation before leaving the bench and retiring in its rooms. She and another judge later approached members of the arrest team at the courthouse with what witnesses described as a “conflictual and angry behavior”.

After a back and forth with the agents on the mandate of Flores-Ruiz, Dugan demanded to speak with the chief judge and removed them from the courtroom, according to the Affidavit.

She then returned to the courtroom and was heard saying words to “wait, come with me” and inaugurated Flores-Ruiz and her lawyer by a rear jury door generally used only by deputies, jurors, judicial staff and defendants in trust, according to Affidavit. Flores-Ruiz was free on a signing deposit in the case of abuse at the time, according to files of online state courts.

The federal agents finally captured him outside the courthouse after a prosecution on foot.

The Supreme Court of the State suspended Dugan of the bench at the end of April, claiming that this decision was necessary to preserve the confidence of the public in the judiciary. A reserve judge replaces her for her.
