- The governor of Delaware, Matt Meyer, says things can “need to change” because companies threaten to incorporate elsewhere.
- Elon Musk led the accusation to leave Delaware after a court rejected his Tesla Pay package.
- Delaware remains a higher destination to integrate, especially among fortune companies 500.
Some companies – partly directed by Tesla and the CEO of SpaceX, Elon Musk – threaten to abandon Delaware and integrate elsewhere.
The new governor of Delaware, Matt Meyer, said, however, that he intends to attract them.
“The fact is that Delaware is the best location in the world for a business to integrate, and it is thanks to our legal expertise dating from 1792. But let’s be clear: if an entity leaves Delaware, we will work to win them “Said Meyer to Business Insider.
Almost 2.2 million entities – “more than ever,” said Meyer – are registered in Delaware, including two thirds of all fortune companies 500, according to the division of state companies.
Meyer said that there was a “competitive environment”, and that his state was to take up seriously the challenges of its laws on businesses.
“Any business thinking of leaving, we hold the hand actively, we talk to them, we understand what are the problems and understand what ways we can do better,” he said. “And for the entities that have already made the decision to leave, we will continue to work hard to gain their confidence and, hopefully, make them come back.”
Musk called on companies to reintegrate the company elsewhere after a Delaware court rejected its Tesla remuneration package by $ 55 billion. Tesla and SpaceX left Delaware last year, reintegrating in Texas.
Bill Ackman, the CEO billionaire of Pershing Square Capital Management, said on a post X on Saturday that he planned to move his Delaware management company to reintegrate into Nevada or Texas.
“Any lawyer always recommending incorporation into the Delaware at this stage should be continued for professional misconduct,” Musk published on X in reference to the ACKMAN Declaration. “Texas or Nevada actually respect shareholders’ rights.”
Meyer said questions such as shareholders’ balance and management rights must be resolved.
“It is really important that we are correct for Elon Musk or who the litigants are in the courts of Delaware,” he said. “We are aware that there may be certain things that should change. We will work on it.”
Although he has been in power for less than two weeks, Meyer said that he had already met “the legal brass of the company” and the heads of government of the state to trace a path to follow.
“I think that in the coming weeks, you will see certain things deployed that will help to advance our state and to lead us in 2025 and beyond to make sure that we protect and cultivate the corporate franchise,” -It declared.
“It certainly beats to go to Vegas and roll the dice,” he added.
A spokesperson for the Delaware court refused to comment.
