The former vice-mayor of Santa Clara, Anthony Becker, officially filed his notice of appeal today, launching a process which could reaffirm or reverse his conviction for having disclosed a report of Grand Civil Jury exploded on the 49ers of San Francisco, then lying under oath.
In December, a jury declared Becker guilty of perjury for crime and violated his duty as a civil servant of the government. He was sentenced to 40 days in a work program in prison in the county earlier this month and presented his first public apology “to the inhabitants of Santa Clara for this long test”.
No information was immediately available with regard to Becker’s reasons plans to call on the case, which will be heard before the Sixth District Court of Appeal. A legal expert previously told Mercury News that his lawyers could say that the judge should have let them present evidence to the jury that someone else could have been the source of the flight.
“Anabricant conduct”, the report of the great civil jury of the County of Santa Clara in question, disclosed several days before becoming public before the election of the town hall of Santa Clara in November 2022, for which Becker was a candidate. The report accused the members of the municipal council, including Becker, of becoming too comfortable with the lobbyists of the 49ers – the NFL team who plays at the Levi’s stadium in Santa Clara.
Rahul Chandhok, the former communications chief for the 49ers, told the trial that Becker had disclosed the report to him. The jury also declared Becker guilty of having disclosed the relationship to a local media.
Before the trial, Becker’s lawyers built a case that someone else disclosed the report and that he was selectively prosecuted by the office of the County Prosecutor of Santa Clara.
“We have reasons to believe, on the basis of the evidence disclosed by the government, that someone other than Mr. Becker disclosed the report of the Grand Jury to the Chronicle of San Francisco among other possible sources,” said deputy defender Christopher Montoya and Grant Fondo and Hayes Hyde of the law firm Goodwin in a statement to Mercury News last year. “To our knowledge, the government has not continued this special flight. We believe that determining who has disclosed the report is important for this case. ”
Last year, Becker’s lawyers assigned the mayor to appear Lisa Gillmor, who Becker tried to relax in 2022, then at the confinite Kathy Watanabe and her husband, Karl Watanabe. Many quotes to appear have been canceled, the deputy prosecutor Jason Malinsky accusing Becker at the time of using “the court to investigate his political opponents and his media organizations which he perceives as hostile to him”.
A judge finally judged that Becker could not use the argument that other people disclosed the report. Throughout the trial, the accusation opposed defense issues that sought to answer who else had access to the report before it was public.
Before the jury was deliberated in December, the Becker’s legal team filed two last -minute separate requests asking that the judge of the Superior Court Javier Alcala completely launched the case. They argued that the accusation had not presented any “substantial evidence” according to which Becker had disclosed the report and asked for a trial for “the reasons that the evidence destroyed, delayed and excluded in this case and interrogation of witnesses” are detrimental. The two attempts were quickly rejected.
Becker’s lawyer and a representative from the district prosecutor’s office could not be joined to comment.
