A former agent of the American border border patrol of the County of San Diego accused of sexual misconduct while he was in service, was sentenced on Friday to be tried on accusations of sexual drums and false accusations of imprisonment.
Prosecutors allege Juan Angel Prishker, 45, who has since resigned from the agency, groped a woman after her detention and showed an image of her genitals with several other people, while being uniform and acting under his quality as an enforcement officer.
During a preliminary hearing to determine whether Prishker could face a trial on several accusation chiefs deposited against him last fall, a judge of the Superior Court of San Diego ordered him to bond on the sexual battery and the false counts of false imprisonment, but rejected four counts of the offense of distribution of obscene issues.
Prishker’s defense lawyer Kerry Armstrong said that his client was working for the Border Patrol for almost 19 years.
One of the victims appointed in the criminal complaint, identified only as Jane Doe 1 in court, testified on Friday through a Hispanophone interpreter that she was detained while he was trying to cross the United States in December 2022.
Two immigration officers gave him to Prishker, who told him to put his hands on his vehicle.
She conformed, and Prishker excavated her and, in doing so, reached under her bra and sets her breasts, she said.
Another woman standing next to her had also been detained and was searched in the same way, according to Jane Doe 1. She said that she had also seen Prishker reaching this woman’s shirt and that the other woman seemed “uncomfortable”.
Another victim appointed in the complaint, Karen Parker, also filed a complaint against Prishker and the federal government.
Parker, a retired social worker who volunteers with migrants, said on Friday that she was in the jacumba region in December 2023 to help migrants who had recently crossed the United States.
She asked for help from the staff of the neighboring border patrol for a woman who needed medical care and had located Prishker, whom she had met on previous occasions.
While speaking with him, Prishker would have said he wanted to show him something and showed him two photos on his cell phone from his genitals, according to Parker.
She testified that she had started to move away from him, but he moved around her and temporarily prevented her from leaving. Parker said that while he was doing this, he kept his hand resting on the butt of his weapon without coastline.
While judge David Berry concluded that there was enough evidence for a jury to decide false allegations of imprisonment involving Parker, he rejected the charges associated with Prishker allegedly showing photos of his genitals in Parker, as well as a group of Internet personalities in a video previously published on Youtube.
The video, entitled “Exhibition of a perverted border patrol agent!” has since been deleted from Youtube. He presented Prishker in uniform, but with his blurred face. The non -edited version of the video played in court showed Prishker and the people – two men and a woman – exchanging sexual remarks. Prishker then shows them his phone and people say it was an image of his genitals.
Berry has judged that the offense relating to the image should be rejected because the image does not rise to the legal definition of obscene matter, which, according to him, requires representations of sexual activity.
Prishker remains out of police custody of his own commitment.
