Last week, however, Le Pen, his party and 23 of his far -right allies were found guilty of having diverted more than 4 million euros in the European Parliament. A panel of three judges made the extraordinary decision – but not unprecedented – to immediately prohibit it from the elections for five years, rather than delaying the punishment until the call process takes place, as usual in France. The decision effectively prohibits the PEN from standing during the presidential election of 2027, unless it is canceled on appeal.

In response, Le Pen sparked an all-powerful attack on a what it considers a system and a judicial power against the National Rally, a strategy that threatens to erode in the democratic system of France.

“This judgment will further polarize the French company, which is already divided and which will become more divided,” said Alberto Alemanno, EU law professor at the HEC Business School in Paris.

Among the problems to which the French political establishment is that if the evidence against Le Pen are convincing, there is a grain of truth in its affirmations that “the system” is against it. The far-right leader systematically had trouble obtaining bank loans to finance electoral campaigns or to obtain the support of enough civil servants to present themselves in the elections, while the so-called republican front sees parties that have little common units simply to prevent the National Power Rally.

Even Le Pen’s political opponents wondered if the court made an error in the 2027 elections, although their criticisms were of the decision itself and remain far from the full-fledged attacks against the independent judicial power from the national rally. The current Minister of Justice declared in November, before he took his post, that he would be “shocking” if Le Pen received an eligibility ban and that it was to be defeated “in the polls, not elsewhere”
