New York (AP) – A judge has no choice but to grant the unusual and divided request from the Ministry of Justice to reject the corruption case of the New York mayor, Eric Adams, a lawyer appointed by the court on Friday. But he recommended that the prosecutors are prohibited from rekindling the accusations so that they do not hang out on Adams “like the proverbial sword of Damocles”.
Paul Clement, who represented the federal government before the Supreme Court as President George W. Bush, said the recommendation to the Federal Judge of Manhattan, Dale E. Ho, in documents filed two weeks after Ho appointed him to provide neutral advice on the case.
In a written submission, Clement told HO that there was “sufficient reason” to reject the accusation without granting the Ministry of Justice to restart them after the election of this year’s town hall, which would leave “a prospect that hangs as the proverbial sword of Damocle on the accused”.
“Regarding the sensitive task of continuing civil servants,” wrote Clement, “the prospect of rediction could create the appearance, if not reality, that the actions of an official are motivated by concerns concerning the respect of the good graces of the federal executive, rather than the best interests of its constituents.”
Adams spokesperson Fabien Levy said on the social platform X: “To quote @NYCMAYOR,” Yeah, DUH. “”
Ho named Clement after The Acting United States Attorney General Emil Bove defended the request during a hearing. Bove argued that the accusations were too close to Adams’ re -election campaign and distracted the mayor to help the The repression of immigration from the Trump administration.
Bove had suggested that the accusations could be reinstated after the elections if the new permanent American lawyer had decided that he was appropriate.
In a file on Friday evening signed by the deputy prosecutor Todd Blanche and Bove, the government continued to argue that the judge should allow the reinstatement of accusations in the future.
They also cited text messages in which prosecutors who worked on the case discussed the strategy and how to react to recent public statements on political corruption by former American lawyer Damian Williams, who resigned at the end of last year.
Blanche and Bove obtained text messages as part of an investigation into the Adams pursuit team that Bove disclosed two weeks ago. They suggested that they would refer these documents if HO performs an audience, saying that “any additional investigation will not reflect well” on Manhattan prosecutors.
The file came the same day, two prosecutors who worked on the Adams – Celia Cohen and Andrew Rohrbach – affair was put on leave while the internal investigation continued, according to a person knowing the action. The person spoke under the cover of anonymity because the person was not allowed to speak publicly.
Cohen and Rohrbach did not respond to messages asking for comments on Friday. Two other prosecutors of the case had already been placed on leave and one resigned.
The government also had to file documents soon in response to a recent request from lawyers for Adams asking that the accusations be rejected “damage”, which means that they could not be refreshed. This request is pending.
Adams was charged in September and accused of accepting more than $ 100,000 in illegal campaign contributions and travel advantages of a Turkish official and other people seeking to buy influence when he was president of the Brooklyn district. He pleaded not guilty and insisted that he was innocent.
HO said the oral arguments, if necessary, could occur next week at the government’s request to reject the indictment.
Bove initially directed American lawyer for Danielle Sassoon To request a dismissal, but she refused, telling the Attorney General Pam Bondi In a letter of February 12 As she proposed to resign that she could not “agree to request a dismissal caused by inappropriate considerations”.
She said that the indictment had been brought nine months before June from New York Primary democratic mayorIn accordance with the long -standing policy of the Ministry of Justice concerning the sensitivities of the electoral year, and the threat of possibly refining the accusations “using the criminal process to control the behavior of a political figure”.
Besides Sassoon, whose resignation was accepted by Bove The day after his letter, six prosecutors, including five high ranks to the Ministry of Justice, resigned before Bove made the request for dismissal, as well as two other Washington prosecutors.
In his recommendation to HO, Clement observed that the decision of the Ministry of Justice to end the case “has precipitated a series of unusual public resignations and public disclosure concerning the internal deliberations and the decision to request the dismissal.”
“It is enough to say that these documents have raised material questions concerning both the initial decision to continue the indictment and the subsequent decision to request the dismissal,” he wrote.
