The driver receives time for killing a woman who would have vandalized his car

OAKLAND – A man accused of deliberately running on a woman, killing her after alleging her car allegedly vandalized, was sentenced to a time he has already served in prison, according to the judicial archives.

Thanks to an agreement with plea with prosecutors of the county of Alameda, Marcus Davis, 38, did not argue any competition with the in -vable manslaughter and officially sentenced to seven years. But Davis also received the credit for the three and a half years he spent behind the bars of Santa Rita prison, doubled with good behavior, leaving him no longer to serve, according to the judicial archives.

In exchange for his plea, the prosecutors abandoned a murder count.

Davis was charged in 2021 for killing Barbara Rivera, 39 years old. The authorities said that at the time he had witnessed his car from Rivera Vandalize, then ran it on purpose, near Fothill Boulevard and Miller Avenue in Oakland. It was taken on nearby surveillance cameras.

Davis was officially sentenced on April 22. His lawyer, Ernie Castillo, said that Davis regretted making “a serious mistake during the pandemic” and that the advocacy agreement reflects “a set of unusual circumstances” around the death of Rivera.

“I expect Marcus to use his freedom to be a positive model for his family and to make sure that something like this is no longer happening,” said Castillo.
