Washington (AP) – A court of appeal withdrew the head of a federal supervisory agency in the last touch of a legal fight against the authority of republican president Donald Trump to dismiss the special council.
The American Court of Appeal for the Columbia district reassured itself with the Trump administration by authorizing the immediate dismissal of Hampton Dellinger at the head of the special council office while the Battle of the Tribunal continues. Dellinger is likely to appeal.
A Washington Federal Judge judged on Saturday that Dellinger should stay in his job, saying that Trump’s attempt to overthrow him was illegal.
Dellinger continued Trump last month after being dismissed, even if the law says that special advice can be withdrawn by the president “only for ineffectiveness, negligence of duty or embezzlement in office”.
US District Judge Amy Berman Jackson, who was appointed to the bench by Democratic President Barack Obama, quickly reinstated Dellinger in the position while he was pursuing his case.
