Quoting “insufficient evidence”, Da refuses to charge Moraga Tennis Coach in sexual abuse probe

Martinez – quoting “insufficient evidence”, the Office of the Prosecutor of the Costa District refused to invoice an East Bay tennis coach arrested in a survey on sexual abuse last year.

Michael Roy Howard, 65, was arrested last November after the complaint of a daughter’s mother to the Moraga police. The prosecutors examined the case against him on February 18 and found “insufficient evidence to prove the case beyond reasonable doubt in court,” said a spokesperson for the office.

However, the problem does not necessarily stop here. Prosecutors say that it is possible that they can review the decision and noted a limitation period of 10 years. However, the passage of time makes such a deposit less likely.

Howard was arrested in November for suspicion of sexual abuse and met a minor with an obscene intention, according to the judicial archives. The police investigation began with the assertion of a teenage mother that his daughter’s tennis coach sent SMS and finally sexually abused the girl.

Police said at the time that they had interviewed the girl who allegedly alleged that she had been mistreated at Moraga’s home in Howard. Prosecutors have not detailed the decision not to accuse Howard beyond the brief declaration.

Howard has been released from prison days after his arrest and has been free since.
