The sobriety of Johnny and Matthew Gaudreau while they were tragically killed during the conduct of their bikes along a New Jersey route should be out of course in the current trial against the alleged driver who struck them, according to the prosecutors.
The Gaudreau brothers were reportedly killed by Sean Higgins on August 29, drunk at the time of the collision. Higgins had a 0.087 tank.
The alcohol content in Johnny’s blood was 0.129, while Matthew was 0.134, according to Documents from the Higgins Defense lawyers.
Now, New Jersey prosecutors want information to be used in case Higgins is tried for guilty manslaughter, according to the New York Post.
The deputy prosecutor of the county of Salem (New Jersey), Michael Mestern, said in a legal file that the quantity of Gaudreau brothers had to drink was not important because of them correctly by following the rules of the road.
Several witnesses told the police that Higgins’ actions alone had caused the accident. They also claim that he was halfway on the road and also on the grass when he contacted the brothers.

Higgins said after the incident he was trying to spend the car in front of him on the right before contacting the brothers. The 44 -year -old argued that he had never seen the Gaudreaus before hitting them.
Higgins said he had drunk five or six beers, including two in his Jeep, before the accident, said prosecutors in the file.
Defense lawyers have counter-advance that the abolition of bac levels of the Gaudreau brothers is “premature” for the case.
Higgins lawyers, Richard Klineburger and Matthew Portella, did not want to disclose more information because of their “test strategy” outside the duo did not want to exclude bac levels due to the “ reconstruction of accidents ”.
