PAC-12, Mountain West accepts mediation in legal control for poaching of penalties, exit costs

The CAP-12 and Mountain West crossed a major step on Wednesday to resolve their legal disputes to more than $ 100 million in poaching and exit costs, revealing that they will engage in mediation.

The process should start on May 19. The mediator is not appointed in the judicial files of the Northern District of California, and there is no date of conclusion of mediation. However, the conferences requested an extension of 60 days on the current suspension of the poaching penalty trial. (This stay was to expire on May 16.)

The Mountain West initiated the conversation on mediation, according to a source.

“While the PAC-12 undertakes to engage in good faith in mediation,” said the conference in a press release published on Wednesday: “We remain confident in the strength of our position and are fully ready to move forward with our case if we cannot reach an acceptable resolution. The PAC-12 took the Mountain West to court last fall more than $ 55 million in poaching penalties that the Mountain West said it was due after the announced departures of five schools (Boisse State, Colorado State, Fresno State, San Diego State and Utah State), which should join the summer 2026.

A second trial emerged at the end of 2024 when the state of Colorado and the state of Utah challenged the exit costs due to the West mountain as part of their planned departures. It is believed that the costs carry a price from $ 19 million per school. Boisse State finally joined the trial.

Discussions on possible mediation started months ago. The May 19 meeting will include both poaching penalty proceedings and exit costs, according to the court deposit on Wednesday:

“While the parties were presented in preview for the court, this mediation will also include parties in a related case deposited in December 2024 before the Court of State of Colorado.”

How long could mediation last? The extension of the stay is requested until July 15, but the process could take a day or several weeks. When the state of Washington and Oregon state took the old schools of the PAC-12 in the fall of 2023 for the control of the conference, mediation required many sessions and lasted three months.

The CAP-12 and Mountain West are looking for media rights agreements for their reconstructed conferences that would start in the summer of 2026. The first has just announced an agreement for the 2025 season with the CW, CBS and ESPN. The three networks would be interested in a multi -year agreement with the conference.

The degree to which the prosecution of poaching and exit jurisdictions have delayed the completion of an agreement with the media is not known.
