Subject: Military mission to seal the southern border of the United States and push the invasions
As Director General and Commander-in-Chief, the Constitution of the United States allows me to direct the various elements of the executive branch to protect our homeland and ensure territorial integrity and sovereignty of the United States in the way that I consider the most efficient and effective, in accordance with the applicable law. Our southern border is attacked by various threats. The complexity of the current situation requires that our soldiers play a more direct role in securing our southern border than in the recent past. Thanks to the executive decree 14167 of January 20, 2025 (clarifying the role of the military in the protection of territorial integrity of the United States), I assigned the armed forces of the United States the military missions to reject the invasion and the sealing of the southern United States of the United States. This memorandum provides additional advice on securing the southern border to the chiefs of certain executive departments.
Section 1. Policy. a) To accomplish the military missions described in the executive decree 14167, and to ensure the security and security of the military and other members of federal staff in the areas of military operations in federal lands along the southern border, the defense secretary, the interior secretary, the secretary of agriculture and the secretary of internal security, will take all the appropriate measures:
(i) provide for the use and jurisdiction of the Ministry of Defense on these federal lands, including the reservation of Roosevelt and the exclusion of Indian federal reservations, which are reasonably necessary to allow military activities directed in this memorandum, including the construction and implementation of the detection and surveillance equipment; And
(ii) provide for the transfer and acceptance of jurisdiction over these federal lands in accordance with the applicable law in order to allow military activities directed in this memorandum to occur on a military installation under the jurisdiction of the Ministry of Defense and for the designation of federal land such as national defense zones by the Secretary of Defense.
(b) The interior secretary will allow the defense secretary to use the parts of the Roosevelt reserve not yet transferred or removed under this memorandum. In accordance with proclamation 10886 of January 20, 2025 (Declaring a National Emergency at the Southern Border of the United States), 43 USC 155 is Hereby Invoked and the Secretary of the Interior May Make Withdrawals, Reservations, and Restrictions of Public Lands to Provide for the Utilization of Public Lands The Department of Defense to Address the Emergency at the Southern Border, Without Regard to Any Limitation On Withdrawals Otherwise Applicable Under the Terms of the Engle Act, 43 USC 155-158.
(c) The Secretary of Defense can determine the military activities which are reasonably necessary and appropriate to carry out the mission awarded in the executive decree 14167 and which are necessary to protect and maintain the security of military installations, in accordance with article 2672 of title 10, code of the United States, and the long-standing authority of a military installation commander to exclude people from a military installation, as section 21 of the internal security section of 1950 ( 797).
(d) By putting activities within the framework of this memorandum, members of the armed forces will follow the rules for the use of the force prescribed by the Secretary of Defense.
Second. 2. Progressive implementation. The Secretary of Defense, the Interior Secretary, the Secretary of Agriculture and the Homeland Security Secretary will initially implement this memorandum in a limited sector of the federal land designated by the Secretary of Defense. Within 45 days of the date of this memorandum, the defense secretary will assess this initial phase. At any time, the defense secretary can extend the activities under this memorandum to additional federal land along the southern border in coordination with the interior security secretary, the assistant of the president and internal security advisor and other executive departments and agencies, if necessary.
Second. 3. General provisions. a) Nothing in this memorandum should be interpreted as altering or otherwise affect:
(i) The authority of the Secretary of Defense to authorize and ask the Governors of the State orders the members of the National Guard under the authority of the title 32 of the United States Code to carry out the activities of the Ministry of Defense, including if necessary to support the activities of application of the law under the responsibility of the Attorney General or the Secretary of Internal Security, if it is requested by such a civil servant;
(ii) the authority granted by law to an executive department or an agency, or at its head; Or
(iii) The functions of the Director of the Management and Budget Office relating to budgetary, administrative or legislative proposals.
(b) This memorandum must be implemented in accordance with the applicable law and subject to the availability of credits.
(c) This memorandum is not intended to create a right or an advantage, a noun or a procedure, enforceable in law or equity by any party against the United States, its services, agencies or entities, its officers, employees or agents, or any other person.
