Lamar Jackson defies the complaint of Dale Earnhardt Jr. of n ° 8

Lamar Jackson’s desire to win the battle of the famous n ° 8 is underway.

Jackson’s lawyers filed an opposition notice on Wednesday with the American Patents and Brands Bureau, saying that the claim of Earnhardt Jr. in conflict with the Double brand “ERA 8” of the NFL MVP-which covers a variety of bags as well as “underwear”, shoes, shoes, frames, summits like clothing (and) underwear.

“Mark de Earnhardt Jr.) falsely suggests a link with people, living or dead, namely Lamar Jackson, well known by number 8,” said the file.

The requests for comments from Earnhardt Jr. and Jackson lawyers were not immediately returned.

The current dispute could take time to settle down, but ultimately, the sides may not be disagreeing for a long time.

In a shared update on Friday, Earnhardt published a declaration on his social networks announcing that he had obtained the rights on classical style n ° 8 which he ran in the early 2000s and had planned to withdraw the other police n ° 8 (that under the protest of Jackson).

“Thanks to the USTPO, we managed to obtain the rights on the 8 stylized,” said Earnhardt. “Therefore, we will move away from the original JRM 8 that we have used since 2019.

“We look forward to the rest of an already successful season.”

Earnhardt Jr. has been associated with No. 8 since the late 1990s, when he broke into the Cup series during the race for Dale Earnhardt, Inc. (Dei) – The race team belonging to its seven time Nascar champion, Dale Earnhardt Sr.

After the death of Earnhardt Sr. in Daytona 500 2001, Earnhardt Jr. had trouble finding common ground with his mother-in-law, Teresa Earnhardt, who took control of the race team. Earnhardt Jr. left Dei to join Hendrick Motorsports after the 2007 season, where he went to No. 88.

Teresa Earnhardt retained the rights of the No. 8 even after Dei finally wilted and closed, but last year, she surprisingly left the rights to expire without renewing them. This encouraged Earnhardt Jr. to make a complaint for his former familiar n ° 8, which he continues to run in the late races of the short track.

This particular n ° 8, with a police force thus associated with Earnhardt Jr., is not disputed by Jackson. A second n ° 8, also tilted but in a different font, is the only Jackson file that buyers would lead to “wrongly believe that the products (Earnhardt Jr.) offered under brand 8 are linked to the products and services provided by (Jackson).”

If this n ° 8 is recorded, explained Jackson, Earnhardt Jr. would receive an “exclusive right to the national scale to use a mark likely to cause confusion” and to “create a false suggestion of a connection” with Jackson.

The dispute was reported for the first time Thursday by lawyer Josh Gerben on his blog.
