James Tupper recently claimed that Anne Heche left him in charge of her estate – after her eldest son, Homer Laffoon, requested access after her death.
In court documents obtained by TMZ on Thursday, the actor alleged that Heche sent him and two other people a copy of his will in 2011 when they were still dating.
He further claimed that the late actress, who died in August after a fire accident, named him executor so that he could carry out her financial wishes.
Tupper – who shared son Atlas with Heche – also sued Laffoon and claimed he was ‘unfit’ to run his mother’s estate, pointing out he was just 20, unemployed and had been separated from Heche when he died.
He further claimed that he tried to get in touch with Laffoon without success.
Meanwhile, Laffoon claimed that Tupper – who was with Heche from 2006 to 2018 – is trying to get his younger brother away from him by controlling his phone and shutting the first one out of their house.
Representatives for Laffoon and Tupper did not immediately respond to Page Six’s request for comment.
Earlier this month, Page Six obtained court documents in which Laffoon asked to be administrator of his mother’s estate because she left no will.
Laffoon was also seeking to be named “ad litem guardian” of Atlas and further asked the court to waive the bond that would be owed.
Regarding the ‘guardian ad litem’ request, Laffoon’s lawyer clarified: “Homer is also in the process of having a ‘guardian ad litem’ appointed by a third party for his younger brother, Atlas (13), to represent the Atlas’ interests in the certification process. .
“Despite reports to the contrary, Homer is not asking the court to name him ‘guardian’, sole guardian, or guardian ad litem of Atlas.”

Heche died at age 53 on August 12 after her car crashed into a Los Angeles home and suffered serious injuries the previous week. Immediately after the incident, she was on life support before being declared brain dead. Eventually, his organs were donated.

The Los Angeles County Medical Examiner-Coroner listed the sternal fracture from blunt trauma as a contributing factor in Heche’s death, which was ruled accidental.
