Customers who purchased Deep River brand chips labeled “Non-GMO Ingredients” may be eligible for a cash payment as part of a class action settlement.
Old Lyme Gourmet Co., the company behind Deep River Snacks, has reached a settlement in a class-action lawsuit alleging it misled consumers with its “non-GMO ingredients” graphic on some bags. Old Lyme Gourmet Co. denies the allegations.
Anyone who purchased snacks in the United States with the label between February 2, 2017 and December 6, 2024 could receive money as part of the settlement.

According to the class action Rankins v. Old Lyme claims that Old Lyme Gourmet Co. labeled some Deep River brand chips with the “non-GMO ingredients” graphic, giving consumers the impression that the snacks were certified by a third party, such as Project No -GMO, as being free of genetically modified ingredients.
The plaintiffs allege that the snacks were not certified by a third party. Old Lyme Gourmet Co. denies the allegations and the court has not yet decided who was right.
TODAY.com reached out to Old Lyme Gourmet Co. for comment but did not immediately receive a response.
People who purchased snacks bearing the “non-GMO ingredients” graphic in the United States between February 2, 2017 and December 6, 2024 can “submit a timely valid claim form” by July 28, 2025.
To file a claim, visit the class action website and click “Start Your Claim.”
According to the site, people can submit a valid claim for:
Each household is limited and can only submit one claim form.
Claim forms submitted after the July 28, 2025 deadline will be rejected and all rights to receive a collective benefit under the settlement will be forfeited.
People can also download a PDF claim form, fill it out and mail it.
