“Damages for Otero family members include uninsured property damage, business interruption damages, emotional/mental anguish damages and costs of third party assistance required in the process Additionally, the Oteros’ home insurance company submitted a concurrent application claiming damages to the property it had subrogated,” said an article posted on the website of Cranfil Sumner, the representing law firm. NASA has six months to respond to this claim.

“If the incident had occurred overseas and a person in another country had been damaged by the same space debris as in the Oteros case, the United States would have been absolutely obligated to pay for those damages under the Convention on International Liability for Damage Caused by Space Objects also known as the “Space Liability Convention,” the law firm said, adding that this case could set the standard for. the future of space debris claims in the public and private sectors.
