Arizona judges have allowed officials to refer to a fetus as an “unborn human being” in public information pamphlets ahead of a statewide vote on abortion in November.

Pro-choice activists criticized the decision, saying the phrase was “biased,” but the state’s highest court said the wording did not violate impartiality rules.

America has been embroiled in a fierce debate over reproductive freedom since the U.S. Supreme Court struck down the nation’s right to abortion two years ago.

On November 5, the issue will again be at the center of debate, when Arizona and other states vote on whether to add a woman’s right to abortion to their own constitutions.

The group Arizona for Abortion Access said voters would be “subjected to biased and politically charged rhetoric, developed not by experts but by anti-abortion special interests.”

She added that she was “deeply disappointed” by the state Supreme Court’s decision, which sided with the state’s Republican lawmakers.

One of those Republicans, House Speaker Ben Toma, called the decision “correct,” the Associated Press reported, and said the move was intended to make it easier for voters to understand.

The court, whose justices were appointed by Republicans, promised to issue a full opinion later, AP said.

In Arizona, women are currently not allowed to terminate a pregnancy after 15 weeks, with some exceptions, due to legislation passed by Republicans in 2022.

The law was passed after the U.S. Supreme Court overturned Roe v. Wade, a landmark decision that struck down the nation’s right to abortion and sparked a national debate over reproductive rights.

In Arizona, in particular, this situation came to a head earlier this year, when state lawmakers fought a 160-year-old law that would have banned abortions almost entirely, with no exceptions in cases of rape and incest.

The state Supreme Court ruled in April that the 1864 law could be enforced. The decision was briefly hailed as a “huge victory” by one anti-abortion group, before State Democrats pushed through repeal bill with help from two Senate Republicans.

Arizona anti-abortion activists find support from state Republicans

At the national and state levels, Democrats have made the abortion issue a central theme of their campaign in the run-up to November 5.

It’s the date of the presidential election as well as the Democratic-backed abortion initiative, like the one seen in Arizona, which was confirmed to be implemented earlier this week.

Many of the states in which these elections are taking place are key battlegrounds that could influence the presidential outcome.

Many Republican politicians have sided with religious conservatives who want abortion banned or restricted in the United States.

In Arizona, the abortion vote will determine whether the state constitution should be amended to allow a woman to terminate her pregnancy up until the point where the fetus can survive outside the womb. That’s usually between 23 and 24 weeks.

The measure would prevent future laws from being passed that would restrict access to abortion — a move that opponents say would go too far.
