Erik Mennendez and Lyle Menéndez could be a step of being released from prison after being sentenced to 50 years for life on Tuesday.
The brothers were condemned for life without parole in 1996 for having murdered their parents, José Mennendez and Kitty Mennendez, in 1989.
Their story resurfaced in public speech after Netflix has published a documentary and a real criminal dramatic series on the case last year.
The drama, “Monsters: The Lyle and Erik Menendez Story”, became an instant success and remained at the top of the most watched table in Netflix for two weeks, while the documentary, “The Menéndez Brothers”, which was released a few days later, presented new interviews with the brothers and sisters.
A title card at the end of the documentary briefly mentions that the brothers filed a Habeas Corpus petition in May 2023 to cancel their murder convictions. But the two Netflix projects leave most of the details on the brothers’ attempts to call on their sentences.

The brothers admitted having killed their parents before their first trial, the jury was therefore responsible for understanding why.
While the accusation argued that the pair wanted their parents’ money, the brothers said they had acted in self -defense because their father had attached them physically and sexually, activated by their mother. They said they feared that their father kills them finally.
The first trial of the brothers ended in 1994 with a suspended jury. In the second trial, judge Stanley Mr. Weisberg limited the testimonies linked to the allegations of brothers’ abuses and suppressed the jury’s option to vote on an accusation of manslaughter. The jury chose that the brothers were guilty of murder during the second trial.
The brothers asked for a call in 2023, which journalist Robert Rand, who reported on their case since the 90s, shared on X. The petition included a letter that Erik Mennendez sent to his cousin Andy Cano a year before him.
The petition also includes a declaration by Roy Roselló, a former member of the group of boys Menodo, which was signed in the label where José Menéndez was a framework. He said José Ménéndez had drugged him and raped him when he was a teenager, and made him do sexual acts twice.
The brothers’ lawyer hoped that it would prove that they defended themselves against the abuse to obtain the slightest accusation of guilty manslaughter.

This new proof was published mid-term in the production of “Monsters” and “The Mennendez Brothers”, which can explain why it was not included.
The producers of “The Mennendez Brothers”, Ross Dinerstein and Rebecca Evans, told Hollywood Reporter in October 2024 that they worked on the documentary for four years and wrapped in shooting in 2023.
Evans said: “Habeas was deposited in 2023, and therefore for us, when we were doing the documentary, we had the impression that we are not there to plead a case. We are not here to present evidence, or new proofs in this way, alongside the lawyers. Our feeling was that it was a story that had taken place then, and that was all our research on this subject.”
“Monsters” was also written before May 2023, even if production was delayed due to the strike of writers and actors in 2023.
“Monsters” the co-creator Ryan Murphy told Variety in September 2024: “I believe in justice, but I do not believe in being part of this machine. It is not my work. My work as an artist was to tell a perspective in a particular history.”
He added that the series was “the best thing that happened to the brothers in 30 years” because it has rekindled the public interest in their case.
But Laurie L. Levenson, professor of law at the Loyola Law School in Los Angeles, told Business Insider in October 2024 that a real series of crimes had to present solid evidence to make a difference in a courtroom.
“Regarding the fact that it is the best thing that has ever happened, only if it leads to evidence to reverse the case, which, I still think, is a real upward battle,” she said.
The County District Prosecutor of Los Angeles began the process of non-compliance with the brothers at the end of 2024.

On October 3, 2024, George Gascón, the Los Angeles County District, told a press conference that his office examined the brothers’ affair.
Later this month, the Los Angeles County Prosecutor’s Office told Business Insider in an email that the “process was already underway” before “Monsters” was first and an audience was set for November 29.
On October 24, 2024, Gascón told a press conference that he had moved the date of decision because his office had been “flooded with requests for information” after the first “Monsters”.
“I decided to move this forward because, frankly, we did not have enough resources to manage all their requests, and one of the things I am prosperous to do in this office is to be very transparent in everything we do,” he said.
Gascón said he would recommend that the brothers be sentenced to 50 years of life and would be eligible for parole immediately.
“I came in a place where I believe that by virtue of the law, respect is appropriate, and I will recommend this to a court tomorrow,” said Gascon.
Gascón said he was fair that the brothers were found guilty of murder, but thought he had been rehabilitated in prison.
In an appointment note tabled on October 24, 2024, deputies of the renowned unit of the DA office wrote that the Menéndez brothers “have shown that they no longer presented risk of public security” and that their “current sentence is no longer in the pursuit of justice”.
Respect is separated from the brothers’ petition to leave their sentences, which means that they should still appear before a parole commission to assert their case before being released.
The same day, Gascón told CNN that he disagreed with the petition argument and that the resentment was more appropriate.
“I think the conviction was appropriate given what was there,” said Gascón.
In October 2024, Gascón also supported the petition of the Menéndez brothers in Gavin Newsom, the governor of California, for Clémence, who was separated from the court hearings. Newsom has the full power to reduce their sentence or to give forgiveness, which means that the brothers now have three ways towards freedom.

Gascón was not re -elected and the renowned audience was postponed to allow the new DA, Nathan Hochman, to review the evidence.
In February, Hochman told a press conference that his office asked the court to refuse the petition of the Brothers of Mennendez. He said he thought that the evidence they presented was not new, was not relevant to their self -defense complaints and did not meet legal standards for petition.
Erik and Lyle Coalition’s judge, an initiative that includes members of the brothers’ family and pleads for their liberation, told ABC News at the time that Hochman’s comments rejected the abuses of the brothers.
“We are deeply disappointed with his remarks, in which he has effectively torn new evidence and discreetly the trauma they have known,” said the coalition. “To say that this did not play any role in the action of Erik and Lyle is to ignore the decades of psychological research and fundamental human understanding.”
In March, Hochman told a press conference that his office was motioning to oppose the brothers’ respect, saying that they had not fully accepted the responsibility of their crimes because they continued to say that they had acted in self -defense. Hochman also said that the brothers had made 20 lies before and during their trial and only admitted four.
The judge, Michael Jesic, rejected the request, the court therefore continued the hearings.
In the midst of the drama, Newsom also asked the Brothers’ conditional liberation committee in February to conduct a “full risk assessment” investigation on the question of whether the brothers present “an unreasonable risk for the public” if they are released.

A hearing took place on May 9 to discuss the risk assessment of the Conditional Liberations Commission. ABC News reported that the evaluation revealed that the brothers have a moderate risk for the community if they are released because they have broken several rules in prison.
But on Tuesday, Jesic approved the dismissal of the brothers, which means that they can now appeal to a parole commission to be released. This process can take years, but the brothers continue to continue the cases of petition and leniency, which could accelerate their release.
ABC News reported that the brothers’ hearing for the Clémence affair is June 13.
