Could the patriots cut Stefon Diggs and do not owe him anything? It’s complicated.

If you believe the initial reports – and you should never – the receiver has signed the Patriots Stefon Diggs to a $ 69 million contract over three years with 26 million dollars guaranteed. The truth is much more complicated, especially since Diggs underwent an LCA torn during the regular season of 2024.

We obtained and examined the entire contract. Until he passes a complete physique (including as the injured knee progresses), he has nothing to do with anything. And this wrinkle raises another question which has recently become very relevant. If the patriots decide to cut Diggs, do they owe him something?

With Scott Zolak, who works for the Patriots Radio Network, recently saying that separation from Diggs is on the tableIt is fair and appropriate to explore if and to what extent it is entitled to a separation gift of several million dollars.

Although the contract does not contain a clear response, several provisions could apply.

First, paragraph 26 of the contract sets out the signature bonus. Under paragraph 26 (A), Diggs obtained $ 12 million, with $ 4 million paid within two weeks of execution, $ 4 million of October 31, 2025 and $ 4 million on March 31, 2026.

Although this implies that he has received $ 4 million, paragraph 26 (B) says this: “The right of the player to receive the amount stated in the paragraph (A) immediately above is expressly conditioned by the player by the player of a physical examination by club, as determined exclusively by the club doctor, confirming his ability to practice and play according to the standards and requirements of his position, in that and the material circumstances, well-being and its performance. »»

Basically, the patriots should not have anything until he has a full effort to clean him to train and play. And the team doctor has an exclusive discretion to determine if Diggs passes. So if the doctor never believes that Diggs is ready to play, the patriots – in theory – owes him nothing.

This does not mean that patriots can tear the contract for any reason before Diggs passes his physique. He nevertheless provides an evacuation hatch, if the doctor who is on the wage bill of the team (and who probably hopes to stay there) never believes that the knee has completely healed.

Second, paragraph 27 (e) focuses on the “preexisting condition” in the knee of Diggs. It eliminates the $ 10.6 million from guarantees beyond the signing bonus of $ 12 million “(i) n the event that the contract is terminated due to the pre-existing condition or any injury or medical which, in the sole opinion of the club doctor, will be final and restrictive, the guarantees set out in this section 27.

This provision evaporates once Diggs passes the physique mentioned in paragraph 26 (B). Which makes this physical even more important. And which gives the patriots a window to pull the catch, if they choose it.

The contract also includes a standard default language for $ 10.6 million in non -signing bonus guarantees. Since the possibility of a suspension for the recent Pink Powder Boat video is lowIt will be difficult to prove that Diggs has committed a defect.

There is also a provision at the end of the contract (paragraph 36) in which Diggs promises that it “will not participate, and is not engaged and will not engage, in any conduct or activity which is illegal, illegal or immoral.” The video of the boat, which shows Diggs distributing a pink powder, could give the patriots an opening to grasp this language – if the powder was an illegal street drug.

Or of course, the patriots should prove it. Which may not be easy to do.

It would be much easier, frankly, to cut it with a failed physical designation, to retain all the money he has not yet received, and to prepare for a grievance like the only former receiver of the Patriots Antonio Brown deposited after the team refused to pay his signing bonus of 9 million dollars after his failed photo of L’Expresso with the PAT.

Finally, the patriots set up the grievance for $ 5 million. Which was still $ 4 million less than they had to Brown on paper.

In this case, the language of the contract gives the team (in particular, their doctor) the ability to put kibosh on the entire contract by determining that the DIGG cannot pass a physique, due to the tear of the LCA.

Here’s the point. Patriots may have paid only $ 4 million Diggs, if that. If Diggs has not yet succeeded in the complete and final physique which erases it to practice and play in 2025 (and the absence of news that he exceeded a complete and final physique strongly suggests that he did not do so), there is an opening to turn this $ 69 million contract over three years in nothing.
