California Woman continues the Catholic hospital channel on the denial of abortion

A woman from Eureka who almost bled to death while last year’s twins continue the Catholic hospital channel who, according to her, refused her care for vital abortion.

Anna Nusslock, a chiropractor who continued the hospital of Providence St. Joseph Eureka and her parents’ parents from the Humbolt Superior Court, said that she hoped that the action would force Californian hospitals to follow state law.

“The work we do will protect people today and it will help people survive,” she said. “I hope to hold the entire responsible providence health system.”

The hospital says that it already complies with the law.

“The experience described in this trial is deeply sad and disturbing,” a spokesperson for Providence South Division wrote in a press release. “We are fully determined to provide care in accordance with federal law and the State, as well as our mission as a confessional organization.

The costume is based on an action in September submitted by California Atty. General Rob Bonta, accusing the hospital of having violated the law on state emergency services.

“There is an existing injunction in the case of the Attorney General, but it is only against the hospital and it is just limited while the dispute is pending,” said Km Bell, main lawyer for reproductive rights and health at the National Women’s Law Center, who brought legal action with Nusslock.

Tuesday’s costume seeks to make the injunction permanent and restrictive for all St. Joseph hospitals from California.

“I was really surprised at the healing of the process,” said Nusslock. “We must put pressure on these hospitals.”

Nusslock and her husband had been trying for years for a baby when she got pregnant with twins at the end of 2023. After her water broke at the end of last February, barely 15 weeks after her pregnancy, she rushed to the emergency room by fearing the worst.

However, despite clear signs, Nusslock’s life was in danger and his twins could not survive, the doctor at the emergency told him that she was not “close to death”, to receive emergency abortion care, according to legal documents.

“I remember saying to someone:” But it’s California! “” Remember Nusslock. “But it is a technicality when the only hospital in which you can have a baby will not help you.”

On the advice of St. Joseph’s emergency doctor, Nusslock hemorrhage drove 12 miles to Mad River community hospital where the two twins were delivered dead, spontaneously and the second by an abortion procedure.

“‘If you try to drive (to UCSF), you will bleach and die before arriving in a place that can help you,’ said St. Joseph’s doctor, according to the costume.

In December, after Mader River closed her work and delivery service, another woman continued the Eureka hospital, alleging that she was refused similar care during three distinct miscarriages.

In the first incident described in her complaint, she traveled half past five in San Francisco “in active work” to obtain help. The second time, she needed two blood units to recover from a preventable hemorrhage. In the third, she alleged that she was left to deliver her dead baby in the hospital toilets.

The woman is now suffering from stress, anxiety and post -traumatic depression “to be denied care in the big hospital alone – and now the only work and childbirth unit – in her county,” said the prosecution.

“Because the complainant desperately wants to have a baby, Providence St. Joseph is certainly the hospital where she will go for her next delivery,” said the trial.

The hospital has denied reprehensible acts in court documents.

As American hospitals consolidate, an ever -increasing number is now managed by Catholic groups. According to the Catholic Hospital Association of the United States, one in seven patients in the United States receives care in one of their establishments. More than 15% of American babies were born in delivery rooms at the Catholic hospital.

After the decision of the Supreme Court in Dobbs against Jackson Women’s Health Organization canceled the right to abortion in 2022, approximately two dozen states limited or prohibited the procedure, about half of them to close exceptions for cases of life or death.

But Catholic hospitals in many protective states of abortion such as California also deny terminations in cases such as Nusslock.

“These refusals are unfortunately not new,” said Bell. “But the situation is more disastrous now after the Dobbs.”

Although St. Joseph agreed last fall to provide emergency care to abortion, the hospital has since reversed the course, seeking to have the pursuit of the State MJ reject on the grounds that conformity affects its right from the 1st amendment to religious freedom.

“SJH could not comply with such an order without abandoning its Catholic identity – the ultimate burden in a case of religious freedom,” said the motion.

Bonta said the hospital flocked the law.

“The stakes could not be clearer: having recognized that they have done so, and will continue to violate a law which forces them to adequately take care of patients who lead medical emergencies putting life in danger, SJH now asks this court to tolerate its conduct by rejecting this action,” the state wrote in opposition to the motion.

The court should rule on the issue on May 15.

In the meantime, Nusslock said that the hospital’s actions had stiffened its determination.

“It was cruel and he continues to feel cruel,” said Nusslock. “You place this religious policy during my real life.”
