A man born in the United States is initially accused of being an “unauthorized foreigner” in Florida was released after spending the night in prison for a 48-hour taking requested by American immigration and the application of customs.
Juan Carlos Lopez-Gomez, 20, was arrested Wednesday by Florida Highway Patrol when the car in which he was rolling was arrested for a traffic stop, according to his lawyer Mutaqee Akbar.
Lopez-Gomez is an American citizen born in the county of Grady, Georgia, where he currently lives in the city of Cairo. He crossed the Florida State Line for his work in the construction in Tallahassee, about 45 minutes from his home.
Lopez-Gomez was released Thursday evening, Thomas Kennedy, spokesperson for a coalition of the rights of immigrants who worked with Lopez-Gomez’s family, told CNN.
“It is free !! thank you to everyone who shared, call (ED) and did something to help secure his release,” said the spokesperson for the Florida Immigrant Coalition in an X article, alongside a photo of an emotional lope-gor surrounded by supporters.
Earlier Thursday, Lopez-Gomez appeared before the virtually court before the County Judge of Leon Lashawn Riggans. The judge received a copy of his birth certificate brought by Lopez-Gomez’s mother, Sebastiana Perez.
“Looking at him, feeling it, and holding it in the light, the court can clearly see the watermark to show that it is indeed an authentic document,” said Rigna, according to the non -profit media Florida Phoenix, who had a journalist in court for the hearing. Florida Phoenix reported history for the first time.
According to the judicial archives, Riggans found no probable cause for the accusation of illegally crossing in Florida, but said that she had no competence to release Lope-Gomez because of the ice taking.
An ice taking or an immigration detainee is when Ice asks the law enforcement organizations to inform him “before publishing a removable extraterrestrial” and “maintaining foreigners for 48 hours” to give the DHS time to take the migrant in police custody.
CNN contacted ICE, the Florida Highway Patrol and the Sheriff’s Bureau of Leon County but did not immediately hear. A spokesperson for the Ministry of Internal Security said the agency examined the incident.
Akbar said family members were informed by ICE detention agents that Lopez-Gomez was going to be released on Thursday evening.
Kennedy, who was at the Leon County Justice Palace to help Lopez-Gomez’s family, said the law on which the Georgia man had been arrested was temporarily blocked by a judge. SB 4-C penalizes illegal immigrants over the age of 18 “who knowingly try to enter this state after entering the United States by escaping or avoiding the examination or inspection by immigration agents.” The bill was signed by Florida Governor Ron Desantis in February, but was temporarily blocked this month by judge Kathleen Williams, according to the Democrat of Tallahassee.
“It is a series of horrors,” said lawyer Alana Greer, director and co-founder of the Community Justice Project which represents the Florida Immigrant Coalition, adding that “no one should have been arrested under this law, not to mention an American citizen.” Greer does not represent Lope-Gomez.
“The judge, the prosecutor, the sheriff and the prison are essentially launching his hand and saying:” Ice told us to hold it, so we will continue to hold it “, even if no one had disagreed with the fact that he was a citizen. Come and get him later, ”said Greer.
