One day after the Trump administration sent dismissal opinions to the vast majority of workers from the consumer financial protection office, a federal judge temporarily blocked the action and ordered an hearing to determine whether the attempted mass dismissal violated an injunction that it imposed last month.
Friday morning, during a brief judicial session, judge Amy Berman Jackson of the Washington Federal District Court pressed lawyers from the Ministry of Justice for more details on the dismissal notices sent Thursday to nearly 1,500 consumer workers. The messages told workers that they would lose access to their messaging accounts and work systems on Friday evening.
Judge Jackson made an oral order, followed by writing, with the exception of the government to carry out this plan until at least April 28, when it plans to hold a proof audience on the issue. His decision came to a trial brought by the staff union of the consumer office and other parties.
“Once again, the court is confronted with evidence that fears that there is no standing agency when it becomes considered the substance,” she said in his written order.
Russell T. Vought, director of the White House budget office, became the acting director of the consumer office in early February and immediately started to dismantle the agency – which cannot be closed without action of the congress. Judge Jackson filed an injunction last month by freezing these actions, saying that it wanted to ensure that the agency existed long enough for the courts to assess whether Mr. Vought’s actions were legal.
A week ago, a panel of three judges from the United States Court of Appeal for the Columbia district circuit carried out the judge Jackson’s order and declared that Trump officials could have decided – after a “particular evaluation” – were not necessary to fulfill the agency’s legally compulsory responsibilities.
